These Terms & Conditions ("Terms") govern access to and use of the IMPAAC platform ("Platform"). By accessing, registering, or using the Platform in any manner, you agree to be bound by these Terms.

1.1 About IMPAAC

IMPAAC is a digital social impact platform operated by IMPAAC IDEA FOUNDATION, a company incorporated under the Companies Act, 2013 (Section 8), having its registered office in India ("IMPAAC", "we", "us", "our").

IMPAAC provides technology, tools, and services to enable NGOs, donors, volunteers, CSR entities, fundraisers, and individuals (collectively, "Users") to connect, manage fundraising, volunteering, CSR-readiness, and impact-related activities.


1.2 Eligibility & User Accounts
  • Users must be at least 18 years of age to register.
  • All information provided during registration must be accurate, complete, and up to date.
  • NGOs must submit valid KYC, compliance, and organizational documents as requested.
  • IMPAAC reserves the right to approve, suspend, restrict, or terminate any account at its discretion, including for non-compliance or misuse of the Platform.

1.3 Nature of the Platform (Important Disclaimer)
  • IMPAAC is a technology and facilitation platform only.
  • IMPAAC does not:
    • Verify or guarantee the credibility, conduct, or performance of NGOs, donors, volunteers, or CSR entities
    • Guarantee fundraising success, donations, CSR funding, volunteering outcomes, or impact results
  • All decisions to donate, volunteer, collaborate, or engage are made entirely at the User’s own discretion and risk.
1.4 Fundraising & Donations
  • NGOs are solely responsible for:
    • Campaign accuracy and disclosures
    • Lawful use of funds
    • Statutory, tax, and regulatory compliance
  • Donations made through the Platform are voluntary and non-refundable unless expressly stated.
  • IMPAAC is not a trustee of funds and does not control or direct fund utilization.

Payment Gateway Charges

  • Payment gateway and processing charges may be borne by:
    • The donor (if enabled), or
    • The NGO (default)
  • IMPAAC is not responsible for third-party payment gateway failures or delays.

1.5 Utilization Reports & Withdrawals
  • NGOs must submit utilization bills, certificates, or reports within the timelines specified by IMPAAC.
  • Standard withdrawal processing time is 0–7 working days after successful compliance verification.
  • Withdrawals may be delayed or withheld due to:
    • Incomplete or incorrect documentation
    • Regulatory or compliance checks
    • Payment gateway or banking delays

1.6 Donors
  • IMPAAC does not guarantee the authenticity, outcomes, or utilization of funds by NGOs.
  • Donors are responsible for conducting their own due diligence before donating.
  • Any tax benefits are subject to applicable laws and NGO compliance.

1.7 Volunteers
  • IMPAAC acts only as a mediating platform between volunteers and NGOs.
  • IMPAAC does not guarantee:
    • Volunteer placement
    • Safety, conduct, or outcomes of volunteering activities
  • Volunteers and NGOs engage with each other independently and at their own risk.

1.8 Subscriptions & Paid Services
  • IMPAAC offers both free and paid subscription plans.
  • Free plans provide limited access.
  • Paid subscriptions unlock additional features such as:
    • Enhanced profiles and dashboards
    • Campaign tools and analytics
    • Promotional and visibility tools
  • Subscription fees are non-refundable unless expressly stated.
  • Custom services (including consulting, content creation, promotions, CSR-readiness) are governed by separate agreements.

1.9 Tips & Platform Support
  • Donors may voluntarily contribute tips to support IMPAAC’s platform operations.
  • Tips are optional and not mandatory for using the Platform.

1.10 Content & Intellectual Property
  • Users retain ownership of their content.
  • By submitting content, Users grant IMPAAC a non-exclusive, royalty-free right to use such content for:
    • Platform operations
    • Marketing and promotional activities
  • Users must ensure they have rights to all uploaded content.

1.11 Prohibited Activities

Users must not:

  • Misrepresent information
  • Use the Platform for unlawful purposes
  • Upload false, misleading, or infringing content
  • Attempt to misuse or disrupt the Platform

1.12 Privacy & Data Protection
  • Use of the Platform is subject to the Privacy Policy.
  • IMPAAC uses cookies and analytics tools to improve user experience.

1.13 Limitation of Liability

To the maximum extent permitted by law:

  • IMPAAC shall not be liable for indirect, incidental, or consequential damages.
  • IMPAAC’s total liability, if any, shall not exceed the fees paid by the User to IMPAAC in the preceding 12 months.

1.14 Indemnity

Users agree to indemnify and hold harmless IMPAAC IDEA FOUNDATION from claims, losses, damages, or liabilities arising from:

  • Breach of these Terms
  • Misuse of the Platform
  • Violation of laws or third-party rights

1.15 Suspension & Termination

IMPAAC may suspend or terminate access without notice for violations of these Terms or applicable laws.


1.16 Amendments

IMPAAC may update these Terms from time to time. Continued use of the Platform constitutes acceptance of revised Terms.


1.17 Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction.

2. Privacy Policy

2.1 Information Collected
  • Personal information (name, email, phone)
  • NGO and organizational data
  • Payment and transaction metadata
  • Usage, cookies, and analytics data
2.2 Use of Information
  • Platform operations and service delivery
  • Compliance verification
  • Communication and support
  • Platform improvement and analytics
  • Marketing and promotional activities (with consent)
2.3 Data Sharing
  • With payment gateways, compliance partners, and legal authorities when required by law
  • IMPAAC does not sell personal data
2.4 Data Security

Reasonable technical and organizational safeguards are implemented.

2.5 User Rights

Users may request access, correction, or deletion of their data via official support channels.


3. NGO Subscription Agreement

3.1 Scope

This Agreement governs paid subscription services availed by NGOs.

3.2 Subscription Terms
  • Billing may be monthly or annual.
  • Auto-renewal applies unless cancelled prior to renewal.
3.3 Fees & Payment
  • Fees are payable in advance.
  • Payment failures may result in service suspension.
3.4 Refunds

Subscription fees are non-refundable unless otherwise specified.

3.5 Termination

IMPAAC reserves the right to terminate for policy violations.


4. NGO MOU (KYC & Platform Association)

4.1 Relationship

This MOU establishes a non-exclusive association between IMPAAC and the NGO.

4.2 NGO Responsibilities
  • Provide accurate KYC and compliance documents
  • Use funds lawfully and ethically
  • Submit utilization reports
4.3 IMPAAC Responsibilities
  • Provide platform access and tools
  • Facilitate fundraising and visibility
4.4 Authority & Content Rights

NGO authorizes IMPAAC to use its information and content for platform and promotion.

4.5 Tips & Platform Support

Donors may voluntarily contribute tips to support platform operations.

4.6 Indemnity

NGO indemnifies IMPAAC against misrepresentation or misuse of funds.


5. CSR Readiness & Assessment Agreement

5.1 Scope of Services
  • Diagnostic assessment
  • CSR-readiness evaluation
  • Recommendations and reporting
5.2 Exclusions
  • No guarantee of CSR funding or partnerships
  • Advisory nature only
5.3 Fees & Payment
  • Fees payable upfront
  • Non-refundable once assessment begins
5.4 Confidentiality

All shared information will be treated as confidential.

5.5 Limitation of Liability

IMPAAC is not liable for CSR outcomes or third-party decisions.
